I. SCHEDULING AND COURT HOURS

  1. Motions. Motions are heard on Mondays. When Monday is a holiday, the next motion date is the following Monday. It is not necessary to clear or reserve a motion date with the court clerk prior to filing the motion, but the motion must be in compliance with all Local and Federal Rules regarding service.

    1. Civil Motions, Status Conferences, and Pre-Trial Conferences are set for Mondays at 8:30 a.m.

    2. Criminal Motions, Status Conferences, Pleas, and Sentencings are set for Mondays at 1:30 p.m.

  2. Trials. Trials are held Tuesday to Friday, from 8:30 a.m. until the Court recesses for the day.

II. MOTION PRACTICE

  1. Mandatory Chambers Copies AND Filing in Santa Ana: All original filings are to be filed electronically pursuant to Local Rule 5-4. The Court requires ONE mandatory chambers copy only to be delivered to the mandatory chambers copy box on the 9th Floor no later than 12:00 p.m. the next business day after filing. Mandatory chambers copies are required for the following documents ONLY:

    Civil Matters:

    All Motions, Oppositions and Replies (including related documents and Exhibits); Joint Rule 26(f) Reports.

    Criminal Matters:

    All Motions, Oppositions and Replies (including related documents and Exhibits); Stipulations and Proposed Orders, Plea Agreements and Sentencing Positions.

    Mandatory chambers copies are NOT required for any other documents such as Stipulations, Proposed Orders, Requests, Applications, Notices, Status Reports, Complaints, Civil Cover Sheets, Answers and Proofs of Service.

    Mandatory chambers copies DO NOT need to be blue-backed.

III. THE COURT’S STANDARD ORDERS

After the filing of a complaint, the Court issues an Initial Standing Order which outlines the judge’s rules and expectations that litigants should be familiar with from the beginning of their case. Once an answer is filed, the Court issues an Order Setting a Scheduling Conference. This order provides important guidance regarding the procedures counsel should follow. At or after the Scheduling Conference, the Court provides counsel with a Scheduling Order. This order confirms the dates selected by counsel and the Court and provides further guidance regarding the procedures that counsel should follow. Both orders should be read and attended to carefully, as compliance with the orders is required. Samples of the Orders can be obtained by clicking on the attachments below.

IV. UNDER SEAL DOCUMENTS

Effective July 8. 2013, procedures for all requests to file documents under seal have changed. Please see order below for instructions.

V. LAW CLERK AND EXTERN HIRING

Law clerk applications should be submitted online through OSCAR (https://oscar.uscourts.gov/). All requirements for law clerks are found on OSCAR. Questions should be directed to the Judge's law clerks, who can be reached at (714) 338-4545.

Externs are hired for the spring, summer and fall terms. All externs are expected to be full-time. Extern applicants should apply in August for spring externships; in December for summer externships; and in February for fall externships. Applicants should send a resume, brief writing sample and transcript (if available) to the following address: Chambers of David O. Counsel are directed to comply with all Local Rules. If counsel have received a "Notice to Parties of ADR Program" (form ADR-08, ADR-10, or ADR-11 with attached "ADR Program Questionnaire" form ADR-09), please see the section on the Court's website entitled "ADR," General Order 02-07, for further information. The ADR section also contains Attorney Settlement Officer information.
